Our terms of service.
These Terms of Service govern access to Title Watch Limited services, including property monitoring, title support, site visits, tax monitoring, subscriptions, one-off services, early customer onboarding, and website use.
Title Watch is an early-stage business preparing to serve its first customers. Some services, account tools, response processes, and plan features may still be in launch setup, pilot, or manual onboarding. These terms are intended to protect both the customer and the company while the service matures, and should be reviewed by Jamaican counsel before broad public launch.
Acceptance of Terms
By using our website, requesting services, creating an account, subscribing to a plan, or paying an invoice, you agree to these Terms of Service and our Privacy Policy. If you are using the services for another person, company, estate, trust, or family interest, you confirm that you have authority to do so.
Our Services
Title Watch provides property monitoring, administrative assistance, and property support services in Jamaica. Services may include newspaper and public-notice monitoring, property tax monitoring, title searches, document review, land titling assistance, site visits, photo or video reports, property management coordination, and transaction support.
Title Watch is not a government agency, law firm, land surveyor, engineering firm, or security company. Unless separately agreed in writing, we do not provide legal advice, legal representation, surveying, structural inspection, valuation, insurance, or law enforcement services.
Launch Status and Availability
Title Watch may offer plans, checkout, account creation, intake, or onboarding before every operational process is fully automated or available in every parish, property type, or customer situation. We may accept, decline, pause, manually onboard, or require additional review before beginning service for a particular property.
If we cannot reasonably provide a paid service after reviewing your property, documents, location, authority, or risk profile, we may cancel the service and issue an appropriate refund for amounts paid for services not yet provided, subject to payment processor rules and any costs already incurred with your approval.
Client Responsibilities
- Provide accurate, current, and complete information about yourself, your authority, the property, ownership records, tax records, and requested services.
- Promptly notify us of changes to your contact information, ownership status, property status, instructions, or risk concerns.
- Maintain access to your email, phone, WhatsApp, and account credentials, where account credentials are available, so you can receive service alerts and billing notices.
- Obtain legal, tax, surveying, engineering, insurance, or other professional advice where your situation requires it.
- Pay all subscription fees, one-off service fees, government fees, professional fees, travel charges, and third-party costs that you approve or that apply to your plan.
Subscriptions and Billing
Subscription plans are billed in advance on a monthly or annual basis unless otherwise stated at checkout or in a written agreement. Prices are listed in United States dollars and may vary by property size, location, risk level, service scope, or custom arrangements.
By subscribing, you authorize Title Watch and its payment processor to charge your selected payment method for recurring fees, applicable taxes, and approved add-ons. Failed payments may result in suspension or cancellation of services.
During launch, payment does not by itself confirm that every feature has started immediately. Service begins after checkout, payment confirmation, onboarding review, and receipt of any documents or authorizations we reasonably require.
Plan Terms
Package features are described on the pricing page or in your written service agreement. Unless we agree otherwise in writing, subscription services are preventive and monitoring in nature and do not guarantee that third-party claims, trespass, fraud, government delays, tax issues, title defects, or encroachment will be prevented.
While Title Watch is launching, listed plan features may be delivered manually, phased in over time, adjusted for feasibility, or replaced with substantially similar support. If a material feature is not yet available for your property, we will try to tell you during onboarding or as soon as practical after we discover the limitation.
- Bronze provides basic monitoring and email alerts with no emergency escalation, site visits, or title search included.
- Silver adds more active oversight and included title-search or site-visit features as described for the plan.
- Gold is intended for diaspora owners and includes regular monitoring, reporting, and escalation features as described for the plan.
- Platinum is intended for high-value, vacant, or higher-risk properties and includes priority response and expanded monitoring features as described for the plan.
Cancellations and Refunds
Unless a separate agreement says otherwise, subscriptions require 30 days written cancellation notice. Fees already paid are non-refundable, including unused portions of a billing period. Early termination may require payment of one additional month of subscription fees where permitted by law and your agreement.
For early launch customers, Title Watch may make practical exceptions where a service cannot begin after onboarding review or where the customer paid before a material service limitation was identified. Any exception is case-specific and does not change these terms for other customers or future billing periods.
Site Visits and Field Services
Site visits are observational only. Reports may include photographs, videos, notes, and visible-condition observations available at the time of the visit. Site visits are not structural engineering inspections, boundary surveys, appraisals, security patrols, or legal determinations.
Third Parties and Public Records
Some services depend on public records, government offices, newspapers, courts, attorneys, surveyors, contractors, tax offices, payment processors, and other third parties. We are not responsible for third-party delays, errors, omissions, access limitations, decisions, charges, or system availability.
Acceptable Use
- Do not submit false, misleading, fraudulent, or unlawful information.
- Do not request services for property you are not authorized to discuss.
- Do not interfere with our website, systems, billing, or security controls.
- Do not use our services to harass, threaten, surveil, or harm another person.
Limitation of Liability
To the fullest extent permitted by law, Title Watch is not liable for indirect, incidental, special, consequential, punitive, or lost profit damages. Title Watch is not liable for acts of trespassers, squatters, fraudsters, government offices, courts, surveyors, contractors, property occupants, or other third parties.
To the fullest extent permitted by law, our total liability for any claim relating to a subscription is limited to the amount you paid to Title Watch for that subscription during the 12 months before the event giving rise to the claim.
Changes to Services or Terms
We may update services, pricing, website content, and these terms from time to time. Updated terms will be posted on this page with a new effective date. Continued use of the website or services after changes become effective means you accept the updated terms.
Governing Law
These terms are governed by the laws of Jamaica, without regard to conflict-of-law rules. Courts or tribunals with proper jurisdiction in Jamaica may hear disputes unless a separate written agreement provides another dispute resolution process.
